1 Privacy Policy

1.1 The Association for European Safety and Infection Control (herein after referred to as "AESIC", Intermandat SA, Petit Chene 38, CH-1003, Lausanne, Switzerland), is committed to protecting your personal information and other data provided to AESIC via this web site. Please read this Privacy Policy carefully as it contains important information about the use of information which you provide to AESIC. This Privacy Policy explains what information AESIC collects about you, and how AESIC collects and uses your information, including setting out the circumstances where AESIC could provide it to third parties.

2 What information does AESIC collect and what does AESIC do with it

2.1 To take advantage of most of AESIC’s services (such as the use of the web site and accessing of available data) you may be required to log on or register. AESIC needs to collect information about you and your computer to enable you to do so and to enable you to continue using the AESIC web site. AESIC may use your IP address to help diagnose problems with its server and to administer the AESIC web site. The information will be collected when you register.

2.2 AESIC will use the information which it collects to personalise your experience on the AESIC web site, to help you log on in future and to continue to use the AESIC web site, and to help AESIC select services or materials which may be of interest to you. AESIC may need to pass your information to third parties who help AESIC to maintain, administer or develop the AESIC web site but, if so, that information is only given to those third parties for that limited purpose.

2.3 AESIC also monitors traffic patterns and usage of the AESIC web site to help AESIC improve its web site designs and lay out. AESIC may pass this information to its partners or other third parties but it will not contain any personally identifying information.

2.4 AESIC may use your information to notify you of news about AESIC, changes to the AESIC web site, special events or new services that AESIC thinks may interest you. If, at any time, you would rather not receive any such information, please send AESIC an email. In those circumstances, AESIC will need to keep your information on file so that you can continue to use the AESIC web site and so that AESIC can deal with the administration and security of the AESIC web site, but AESIC will not e-mail you or contact you by telephone, fax or post.

2.5 AESIC reserves the right to access and disclose personal data or information to comply with applicable laws and lawful government requests, to operate its systems properly, or to protect itself or its users.

3 Sharing of information with third parties

3.1 From time to time, AESIC may choose to pass your details to carefully selected, trusted third parties so that they can also provide you with details of other services that might be of interest to you. If you do not wish AESIC to do so, you should follow the procedure set out in paragraph 2.4 above and AESIC will not provide your information to third parties for such purposes.

3.2 If AESIC does disclose information to third parties, AESIC will only do so to third parties who comply with the Swiss data protection laws (or equivalent data protection laws in other countries) or whom AESIC is satisfied with and have appropriate measures to protect data. However, in some cases a breach of security may be made by a third party for which AESIC cannot accept responsibility.

4 Your consent

4.1 You acknowledge and agree that:

4.1.1 in the course of registering and using the AESIC web site and any services offered via the AESIC web site, certain information about you may be captured electronically or otherwise and transmitted to AESIC or and, potentially, to any third parties as set out above or to third parties who host AESIC web servers or assist AESIC in maintaining the AESIC web site; and

4.1.2 AESIC may send your information outside of the European Economic Area for processing or use in accordance with this Privacy Policy.

4.1.3 by using the AESIC web site, you expressly agree to the collection and use of your information as set out above for the purposes set out in this Privacy Policy.

5 AESIC's responsibilities - how does AESIC protect user information?

5.1 When you review your account information or enter into transactions, AESIC offers the use of a secure server. The secure server software encrypts the information that you input before it is transmitted to AESIC. To prevent unauthorised access, AESIC follows legally required security procedures in the storage and disclosure of information which you have given to AESIC. This means that sometimes AESIC may ask for proof of identity before AESIC discloses personal information to you.

5.2 Certain areas of the AESIC web site where transactions are entered into, reviewed or transmitted are password protected. You can help to preserve your privacy by never sharing your password with anyone else.

5.3 AESIC seeks to limit its members’ access to your information to those members who need to have such information to service your account. AESIC emphasises to its members the confidential nature of user information and the high level of importance which AESIC places on maintaining this confidentiality. Furthermore, any companies AESIC hires to provide support services must comply with AESIC’s privacy policies.

6 What are ‘cookies’ and how does AESIC use them?

6.1 AESIC may conduct analyses of user traffic. These analyses will be performed through the use of IP addresses and cookies which are required to ensure a secure server connection.

6.2 A cookie is a piece of information that is stored on your computer’s hard drive by your web browser. On visiting the AESIC web site, your computer server may use the cookie to guarantee a secure connection. Most browsers accept cookies automatically, but usually you can alter the settings of your browser to prevent automatic acceptance. If you choose not to receive cookies, you may not be able to use the AESIC web site.

7 Changes to Privacy Policy

AESIC reserves the right to add to or change the Terms of this Privacy Policy in its sole discretion, without prior notice to you. If AESIC changes this Privacy Policy, AESIC will post the new Privacy Policy on the AESIC web site, and it will become effective from the time of posting to the AESIC web site. Please visit this Privacy Policy on a regular basis to make sure you have read the latest version and you understand what AESIC does with your information. Wherever possible, AESIC will give you notice of any changes prior to their implementation.

8 Applicable law and place of jurisdiction

These terms and conditions shall be construed, enforced and performed in accordance with the substantive laws of Switzerland without reference to principles of conflicts of laws. The place of jurisdiction is Lausanne, Switzerland. AESIC makes no representation that any information, materials or functions included are appropriate for use in any other jurisdiction. If you access AESIC’s site you do so on your own initiative and are responsible for compliance with applicable local laws and regulations.

AESIC does not assume any liability for timely, trouble-free and uninterrupted access to the Internet. AESIC declines any liability for persons, property damage or especially direct, indirect, immediate or subsequent pecuniary loss.

8 Severability clause

If any article, section or provision of these terms and conditions is found to be invalid, the remainder of them shall continue in full force and effect. Any terms and conditions which are null or void, are in this case to be understood such that their intended purpose is still fulfilled as far as possible.

9 Applicable law and place of jurisdiction

These terms and conditions shall be construed, enforced and performed in accordance with the laws of Switzerland without reference to principles of conflicts of laws. The place of jurisdiction is Lausanne. You agree that any action at law or in equity that arises out of or relates to these terms will be filed only in the courts of the Canton of Vaud, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
